Warrants

There are several different categories of warrants that are exercised by the court.  The most common warrant is often referred to as a bench warrant.  Bench warrants are issued when a defendant has failed to appear in court.  The police can arrest you at any time, without warning, and bring you to court to answer for your previous absence.  Is there a warrant out for your arrest?  Contact The Law Offices of Matt Fakhoury for a free consultation to clear up the warrant hanging over your head.

Misdemeanors

A common misconception is that misdemeanor charges are minor or trivial cases.  People often believe that they are automatically expunged or cleared from your record when the case ends.

The reality is that people are sentenced to supervision, probation and even jail on misdemeanor cases.  If such a sentence occurs, a misdemeanor can have lifelong consequences on your future and especially job prospects.  Even if your misdemeanor case is dismissed, the arrest is not automatically cleared and will show up on a background check.

That is why it is imperative to select a criminal defense attorney devoted to your case and with an eye towards your future.  Our office is devoted solely to the practice of criminal defense and we specialize in expungements and sealings.  We will create an individualized legal strategy tailored specifically to you and the ability to possibly clear your record.

Have you been charged with a misdemeanor? Contact Matt Fakhoury for a free case review.

CDL Drivers

Individuals who have a commercial drivers license (CDL) are held to higher standards by the Secretary of State and are therefore more likely to get their license suspended for simple traffic violations than other drivers.  When a CDL driver is ticketed for a moving violation, even a sentence of supervision can cause an increase in insurance rates and a driving suspension.  Most employers will subsequently terminate your employment if you cannot drive. When your livelihood depends on your ability to drive, it is vital to have an attorney help maintain your driving privileges. Contact Attorney Matt Fakhoury to discuss your options.

Important Change to the Expungement Laws

Prior to 2012, if you were sentenced to supervision on a misdemeanor Retail Theft, the law required a 5 year waiting period from the date your sentence was successfully completed before an expungement could be filed.  However, in 2012, the waiting period was reduced to only 2 years which allows you to clear your criminal record sooner!!!  If you were ever charged with a retail theft and need your record cleared, contact the experts at XpungeChicago – A Division of the Law Offices of M. Fakhoury!

4th of July - Road Side Safety Checks

Independence Day is a great time for family and friends to get together to celebrate our country's heritage.  However, police often use holidays like this to conduct road side safety checks in the hopes of catching drivers who are under the influence of drugs or alcohol. Stay safe this independence day by having a designated driver after the festivities are over.  Happy 4th Of July from the Law Offices of M. Fakhoury.

Field Sobriety Tests

With the 4th of July around the corner, police will be out in full force conducting road blocks and random checks in the hopes of detecting drivers who are under the influence.  As soon as an officer asks you if you have been drinking and to step out of the vehicle, he has already made the decision to arrest you.  The only thing he is subsequently doing is attempting to build a strong case by asking you to perform standard field sobriety tests (FST).  The results of these tests will later be used as evidence of your impairment and intoxication.  What most people do not know is that  you are under no obligation to perform the tests!!!  Although the police may nevertheless arrest you, the evidence and the strenght of the State's case will be minimized.  Contact Attorney Matt Fakhoury for more helpful DUI tips.

DUI

In the 1980s and 1990s, Driving Under the Influence of Alcohol was not punished as severely as it is today.  As society’s awareness of the seriousness of DUI offenses increased, so did the penalties.  Today, DUI can be charged as either a Felony or Misdemeanor depending on the circumstances of the case. The sentence, fines, and even social stigma of being found guilty of a DUI can have life altering consequences.  Contact Matt Fakhoury, a former DUI prosecutor, to get the defense you deserve.

Clear Your Record!

Illinois, unlike most other states, allows individuals who plead guilty and receive supervision and even probation on a criminal case to eventually clear their record.  This unique area of the law is considered an expungement and if granted, both the arrest and court records are destroyed.  To be eligible for an expungment, you must meet certain criteria.  Is an old criminal case preventing you from getting a job?  Contact the Law Offices of Matt Fakhoury for a free ove the phone case review for immediate answers.  You can also get more information at XpungeChicago.com
